Buying a home - Part 1: purpose, budget, identity and rights

Part one covers the transaction and budget, identification of the property and right-holder and the documents needed for review.

Define the transaction and budget

A home, investment unit, property said to have development rights or planning potential, and a renovation project are different transactions. Use, horizon, finance, possession date and risk tolerance should be defined before commitment.

The full budget includes the price as well as taxes, finance, brokerage, inspections, registration, works, moving and contingency.

Identify the property and right-holder

A street address does not replace the applicable registry identifiers, such as block, parcel and sub-parcel where they exist, and the correct rights document. Check the registered holder, source of title, recorded liens or notes and signing authority.

A registry extract shows recorded information when issued; it does not by itself establish that there are no unregistered undertakings, unauthorised uses or discrepancies. Where rights are administered by the Israel Land Authority, a housing company or another register, the due-diligence and transfer route changes.

Documents required before negotiation

The initial file includes title records, plans, planning information, municipal records, leases, building records and finance data. XPlan or a planning file helps locate plans but does not by itself establish a vested development right for the particular property.

As a risk-management rule, material money or a binding document should not be delivered before review. This is not a statement that every early payment is prohibited by law; the appropriate structure depends on the transaction and protections agreed.
